Introduction

These Terms and Conditions govern participation in the promotional raffle (hereinafter, the “Raffle”) organized by Blue Dawn Marketing Consulting Group S.L. with registered office at Calle Santa Rita 1, San Pedro de Alcantara 29670 Spain (hereinafter, the “Company”) and the individuals who wish to participate in the Raffle and do so at their own discretion (hereinafter, the “Participants”).

1. Data Processing and Privacy Policy

1.1. By participating in the Raffle, Participants expressly agree that their personal data may be collected and processed by the Company, as data controller, for the sole purpose of managing their participation in the Raffle, including, but not limited to, verifying eligibility, selecting and contacting winners, and delivering prizes.

1.2. The legal basis for this processing is the Participants’ consent and the performance of the contract arising from participation in the Raffle. The personal data processed may include your name, contact details and any other data strictly necessary for the administration of the Raffle.

All personal data will be processed in accordance with the provisions of Regulation (EU) 2016/679 (General Data Protection Regulation - GDPR) and applicable national legislation. The data provided by Participants shall not be sold, transferred, or disclosed to any third party without the express consent of the data subject, except where legally required.

1.3. Participants may exercise their rights of access, rectification, erasure, restriction of processing, objection and portability of data by contacting legal_eu@getblue.io. They also have the right to lodge a complaint with competent supervisory authority.

1.4. The personal data collected will be used exclusively for purposes directly related to the execution and management of the Raffle, as well as for promotional communication purposes by the Company, i.e. sending marketing materials via email.

1.5. Participants retain the right to withdraw their consent at any time by contacting the Company via email to marketing_eu@getblue.io and requesting the cessation of all promotional communications and, where applicable, withdrawal from the Raffle.

2. Raffle Mechanics

2.1. Participation in the Raffle is entirely free of charge and does not require any form of monetary contribution from Participants. Entry into the Raffle shall be deemed complete upon submission of the designated entry form.

2.2. To be eligible to participate in the Raffle, individuals must:

• Be at least 18 years old.
• Have physically attended the event where the Raffle is held.
• Correctly complete and submit the official entry form.
• Be in possession of a valid passport enabling travel within the European Union and the Schengen Area or be willing to obtain a visa if required for the destination.
• Accept these Terms and Conditions by clicking the corresponding checkbox.

2.3. The selection of the Raffle winner shall be conducted using the online tool Comment Picker, into which only the full names of the Participants will be entered in order to generate a list of all eligible entrants.

The tool will then randomly select one name from the list to determine the winner. The entire process will be conducted in a transparent and verifiable manner, under the supervision of the Company. A formal record will be kept indicating the date, time, and full name of the selected winner.

No personal data other than the Participant’s full name will be entered into Comment Picker. In accordance with the platform’s privacy policy (https://commentpicker.com/privacy-policy.php), “Comment Picker do not store the names of Participants or any other personal data on our server. If you choose to not store the result of your giveaway as free user and close your browser, the data will be permanently deleted.”

As the Company will utilize the free version of the Comment Picker tool and opt not to store the results, all data processed by the tool will be permanently deleted immediately upon the closure of the session, ensuring that no personal information will be stored by the Raffle tool.

2.4. The winner will be contacted directly via the email address provided in the entry form, within a maximum period of two (2) weeks following the conclusion of the event. The selected winner must confirm acceptance of the prize within forty-eight (48) hours of receipt of said notification.

2.5. Failure to respond within the stipulated timeframe or an explicit rejection of the reward will be interpreted as a waiver of reward. In such cases, a new random draw shall be conducted following the same procedures to designate an alternate winner, subject to identical conditions and timelines.

3. Raffle Prize

3.1. The prize awarded in this Raffle consists of a Waynabox travel experience, which includes 3 days / 2 nights in a surprise destination within Europe, with round-trip flights and hotel accommodation included, departing from London (United Kingdom). The total value of the prize is €300 (three hundred euros).

4. Tax Obligations and Liability Disclaimer

4.1. Participants are advised that, depending on their country of residence and applicable local legislation, the receipt of the reward may give rise to tax obligations, including declaration or payment of taxes.

4.2. For example, under the Royal Decree 439/2007 of 30 March, which approves the Spanish Personal Income Tax Regulations (IRPF), Article 75.3.f establishes that no withholding or advance payment is required for prizes from Raffles provided the prize does not exceed €300.

4.3. Accordingly, Participants acknowledge and accept full responsibility for any and all tax liabilities that may arise in their country of residence as a result of accepting the reward, thereby exonerating the Company from any fiscal or legal responsibility in this regard.

By accepting these Terms and Conditions, Participants declare their understanding and agreement with all provisions contained herein.
